Dmitry Kheyfits

Principal

Dmitry Kheyfits represents clients in patent litigation and licensing. As lead litigation counsel, Dmitry formulates appropriate strategies for the enforcement, licensing, and litigation of patent portfolios.  He has appeared in over 30 patent cases, including cases pending in the Eastern District of Texas, the District of Delaware, the Southern District of New York, and the Federal Court of Claims.  Dmitry also represents clients in licensing negotiations away from the courtroom.

Dmitry earned a dual Bachelor of Science degree in Electrical Engineering and Computer & Systems Engineering from Rensselaer Polytechnic Institute. Following an internship with IBM and a full-time systems engineering position with Lockheed Martin, Dmitry joined the intellectual property department of Jones Day as a patent agent. Upon earning a Juris Doctor from Fordham University School of Law in 2008, he was accepted into the intellectual property department of Jones Day as a patent attorney.  In 2010, Dmitry joined Desmarais LLP, a law firm specializing in litigation of complex, technology driven disputes, leaving the firm in 2012 to establish his own practice.

  • Currently representing a developer of optical disk technologies in licensing negotiations and litigation relating to its patent portfolio.
  • Currently representing a developer of signal processing technologies in patent infringement litigation.
  • Represented an e-commerce company in a patent infringement lawsuit against providers of online shopping technology.
  • Represented a software company in a patent infringement lawsuit against online backup providers.
  • Defended a computer manufacturer in an antitrust and patent infringement action involving a licensing conglomerate.
  • Defended a Fortune 500 networking company in a patent infringement lawsuit brought in the Eastern District of Texas.
  • Defended a large semiconductor company in a patent infringement lawsuit involving fabrication technology.
  • Defended a Fortune 500 memory company in a patent infringement lawsuit involving multimedia devices.
  • Represented a marketing company in a breach of contract and fraud action.
  • Defended a luxury goods manufacturer in a breach of contract claim relating to the purchase of an enterprise IT system.
  • Defended a Fortune 1000 human resources company in a breach of contract claim relating to implementation of a software system.

  • Established patent application portfolios for numerous start-up companies.
